Many rumors exist surrounding involvement in a motor vehicle accident with a vehicle with questionable insurance coverage. Being involved in a collision is an extremely stressful experience and to be involved in one with possibly no insurance coverage simply adds to the anxiety and stress that an injured person is under. In Ontario, relief exists for those who have had the unfortunate experience to have been involved with another vehicle which is found to be uninsured. Sault Ste. Marie is intersected by our national highway and is also a busy international border crossing. This means many motorists routinely travel through our area and in turn this means you may be faced with an accident involving a vehicle which is insured in another province of Canada or in the United States. An accident may also involve a hit-and-run, whereby it is unknown whether the other party is even insured. We are well-experienced in these situations that are most often extremely complicated.
You can find more details about uninsured, underinsured and unidentified situations in item 20 on our FAQ page.
WHAT COMPENSATION IS AVAILABLE
Under Ontario’s no-fault auto insurance system, anyone injured in a car accident can apply for accident benefits from their own insurance company, even if another person was at fault. Additionally, if you aren’t insured at the time of the accident, you can apply to the insurance company of the other vehicle involved in the accident or to the insurance company of an immediate family member such as a parent or spouse.
If you or a loved one has been injured in a car accident, you may be entitled to receive compensation for damages such as:
Since many insurance companies aren’t forthcoming about all the accident benefits available to you, it’s important to seek professional legal advice to determine your rights and obligations. A motor vehicle accident lawyer can help you explore your legal options and ensure you receive the compensation you’re entitled to.
WHAT TO DO AFTER BEING INJURED IN A CAR ACCIDENT
Dealing with the aftermath of a car accident can be overwhelming. However, it’s important to follow certain steps to ensure that future legal issues or claims are dealt with appropriately. Here are five steps you should take after being in a car accident:
1. Report the accident to the police
You’re legally required to report the accident to the police so they can complete a police report.
2. Document the accident and gather information
You should collect as much evidence as you can about the accident to help support your accident benefits claim. It’s important to record:
3. See a doctor
You should immediately see a medical professional to accurately assess your condition. It’s important to keep records of any medical testing, prescriptions, treatments and therapy you receive as this evidence will be extremely helpful in securing fair compensation for your damages.
4. Contact your insurance company and make a claim
You must inform your insurance company of your injuries within seven days of the accident. If you don’t, your claim may not be honoured. Once you do this, the insurance company will provide you with an Application for Accident Benefits form which must be completed and returned within 30 days.
5. Consult a lawyer who specializes in motor vehicle accidents
Speaking with a personal injury lawyer will help you determine what options are available to you and if you have a case. The sooner you speak with a lawyer, the faster they can create a legal strategy to help get you the compensation you deserve.
WHY YOU SHOULD WORK WITH A PERSONAL INJURY LAW FIRM
Involvement in an automobile accident may be as a driver or passenger in a car, truck, taxicab, limousine or a bus. You may also be a pedestrian or traveling on a bicycle. In some cases, you may be in a company vehicle and be confused as to the proper route to proceed, be it with a lawyer or through the Workplace Safety & Insurance Board (WSIB). Each situation has its own unique set of circumstances. We have the experience and the knowledge to properly advise you of how to proceed if you were injured in a company vehicle or were involved in a motor vehicle accident during the normal course of your employment.
Applying for accident benefits following a car collision is a complex process that involves adhering to tight deadlines and completing complex paperwork. At Feifel Gualazzi, our lawyers will help you through every step of the process. We can advocate and negotiate with insurance companies on your behalf so you can focus on your treatment and recovery.
ACCIDENT BENEFIT LAWYERS IN SAULT STE. MARIE
Applying for accident insurance benefits can be challenging. Even after filing motor vehicle accident claims, you can wait months to receive benefits. Your insurance company can even deny your claim, leaving you struggling financially while you recover from your injuries. Fortunately, an accident benefits lawyer at Feifel Gualazzi Personal Injury Law Firm can help you receive the benefits and treatments you’re entitled to.
FINANCIAL HELP IS AVAILABLE IMMEDIATELY AFTER AN ACCIDENT
In Ontario, regardless of fault, injured individuals are entitled to accident benefits through their automobile insurance policy. If you don’t own an automobile or have accident benefits coverage, you may be able to claim compensation through the province’s Motor Vehicle Accident Claims Fund in some cases, even if you were at fault.
Confusing, we know. But Feifel Gualazzi can assist you from the initial application process and ensure you get all the benefits and treatments you’re entitled to.
WHAT IS AN ACCIDENT BENEFITS CLAIM?
The accident benefits claim is your first step after being involved in an accident, whether you’re a driver or pedestrian, and whether you’re at fault or not. Accident benefits cover out-of-pocket expenses, including ambulance fees, housekeeping, childcare and funeral expenses. You can claim for treatment and rehab of injuries like whiplash or broken bones on your insurance claim.
At a time when your income may be reduced or eliminated due to injury, added expenses can be overwhelming. Whether or not you’re at fault, accident benefits cover many out-of-pocket expenses, including:
WHAT TREATMENTS DO ACCIDENT BENEFITS COVER?
Treatments are a vital part of the long and often winding road to recovery. These may begin with a visit to the emergency department or your family physician. Medical treatments and rehabilitation may include but not be limited to psychological treatments, physiotherapy, chiropractic treatments, massage therapy, exercise therapy and programs, gym memberships and more.
You may or may not possess coverage through an extended medical benefit plan, but accident benefits may provide coverage for these types of treatments. Accident benefits may also provide a means for you to obtain specialized diagnostic testing or referrals to specialists not available through OHIP.
HOW TO SUBMIT AN ACCIDENT BENEFITS CLAIM
Applying for accident insurance benefits is fraught with tight deadlines. Numerous restrictions and strict time limitations are a very real part of Ontario’s accident benefits system. Failure to submit the proper paperwork may make you ineligible for accident benefits coverage.
Not sure how to make a claim under your accident insurance benefit plan? Here’s what you need to know.
Unless you have prior experience, accident benefit claims can be unclear territory. Insurance companies aren’t always forthcoming about all the benefits available to you when you file an accident benefits claim.
If you’re fearful of missing a key step in the process, the accident benefit lawyers at Feifel Gualazzi are courteous and sympathetic to our clients’ needs and navigate you through it.
HAVE YOU WAITED TOO LONG FOR YOUR BENEFITS?
Many individuals who’ve been hurt in a motor vehicle accident have applied for accident benefits days, weeks, months or even years ago and have yet to achieve a resolution to their claim. Often, an injured person is met with a denial of benefits by their own insurance company. You trust your insurance company and believe them when they tell you you’re not entitled to the benefit.
The sad truth is that, in many cases, nothing could be further from the truth, and the insurance company’s denial may not be justified by law. You’re not on a level playing field with the insurance company. You may be unfamiliar with the voluminous and complex accident benefits legislation and regulations. You’re up against your insurance company, which has full-time representatives working to serve their own interests and often to your detriment.
In non-motor vehicle accident cases, settlements can typically be reached within 12–18 months. However, this is not possible with motor vehicle accident cases. It is not possible to sue in a motor vehicle accident case for minor injuries, one must wait until it can be established that the person has sustained a permanent and severe impairment. Feifel Gualazzi will fight vigorously for you to dispute the insurance company’s wrongful denial. We’ll ensure you receive all the treatments and benefits you’re entitled to.

UNDERSTANDING THE CLAIMS PROCESS FOR UNPAID ACCIDENT BENEFITS IN ONTARIO
Navigating the claims process for unpaid accident benefits in Ontario can be complex and challenging, especially when you are dealing with the aftermath of a motor vehicle accident. The Statutory Accident Benefits Schedule (SABS), governed by Ontario Regulation 34/10 under the Insurance Act, outlines the benefits available to individuals injured in automobile accidents and the procedures for claiming them.
When you are injured in a motor vehicle accident, either as an occupant of a vehicle or as a pedestrian and regardless of who was at fault, you are entitled to statutory accident benefits as part of your auto insurance policy. These benefits are designed to cover medical expenses, rehabilitation, income replacement, attendant care, and other related costs that arise due to your injuries.
The claims process typically begins with notifying your insurance company promptly after the accident. You must submit an application for accident benefits along with any required documentation, such as medical reports and proof of income. The insurer will then assess your claim to determine eligibility and the extent of benefits payable. If benefits are unpaid or unreasonably delayed, it is crucial to seek legal advice to ensure your rights are protected and to challenge any denials or underpayments.
At Feifel Gualazzi, we guide you through every step of this process. Our law firm understands the timelines, documentation requirements, and legal nuances involved in accident benefits claims. We advocate on your behalf to secure the benefits you are entitled to under Ontario law, helping you focus on your recovery without the added stress of navigating insurance disputes.
THINGS TO KNOW ABOUT STATUTORY ACCIDENT BENEFITS IN ONTARIO

In the Province of Ontario, compensation is available if you have been involved in a motor vehicle accident and have suffered injuries. Legislation is always changing, and many individuals believe that Ontario’s no-fault insurance system prevents them from seeking financial compensation from the at-fault party.
This is not necessarily the case. Every individual, every accident, and every case is different.
You will be entitled to accident benefits from your own insurance company even if you are at fault. You may also have the right to obtain compensation from the insurance company of the party or parties at fault for your accident should you not be at fault for the accident. To summarize, if you are at fault for the accident, you will have significant rights for compensation from your own insurance company. If you are not at fault, generally you will have significant rights against your own company and the insurance company of the at-fault driver.
COMMON INJURIES
Many people in Northern Ontario enjoy riding snowmobiles, ATVs and motorcycles. Though these activities provide hours of fun, it’s easy to wipe-out, flip or even crash. This can result in severe bodily harm. The most common personal injuries following an ATV, snowmobile or motorcycle accident include:
The treatments for these types of injuries can be costly and the affected person often requires extensive ongoing physical therapy and rehabilitation. In addition, the injuries may prevent them from returning to work. At Feifel Gualazzi, we believe that no one should have to carry that financial burden alone. Our personal injury lawyers will work with you to file an accident benefits claim to ensure you’re compensated for out-of-pocket expenses.
INJURY COMPENSATIONS
In Ontario, if you’re injured in an ATV, snowmobile or motorcycle accident, you’re entitled to file an accident benefits claim with your insurance provider, even if you’re at fault. If someone else was at fault, you may also be able to sue for damages. The amount of compensation or damages you’re entitled to will vary depending on the severity of your injuries. You may be entitled to coverage for:
It’s important to note that ATV, snowmobile and motorcycle insurance also protects you against hit-and-run accidents and uninsured riders. If you’re wondering if you have a case, the lawyers at Feifel Gualazzi are happy to answer your questions.

Serious and catastrophic injuries impact not only individuals but their families as well. We are here to assist both, especially in those early and confusing days following injury.
The road to recovery is a long one, and we are here to assist you every step of the way, often beginning with the early days in hospital. Legal expertise in the area of catastrophic injuries is vital to achieve proper compensation.
Catastrophic injuries pose unique challenges to any legal team and it is important to trust that your legal team is aware of just how to properly protect your rights and ensure you receive proper compensation for your injuries.
WHAT IS CONSIDERED A SERIOUS INJURY?
The following types of injuries are defined as serious injuries:
Catastrophic Injuries
Catastrophic injury has a special meaning and definition in law. The AMA (American Medical Association) 4th Edition definition is utilized in Ontario. An injured victim can be catastrophically injured if the person after an accident has a GCS (Glasgow Coma Scale) of 9 or under for a reasonable period of time or has a 55% whole body impairment. One can also meet the definition of being catastrophically impaired if a person has a severe emotional or psychological injury and has either a marked impairment on one or more of four spheres including work adaptation, activities of daily living, social functioning or concentration. Other tests apply based upon the GOS (Glasgow Outcome Scale) Class 5 for extreme impairment and special considerations are given to children. The percentage of a brain injury, other physical injuries, and emotional or psychological injury from a marked impairment can be added together to determine if the injured person has a 55% whole body impairment.
The determination of catastrophic impairment is extremely important because if the injured victim meets the definition, the insurance company responsible to pay no-fault accident benefits must pay up to $1,000,000 of medical-rehabilitation benefits for the injured person’s lifetime. In addition, if a person is determined to be catastrophic, housekeeping is paid for life, income benefits are paid for life, attendant care is payable up to $6,000 per month and is payable for life up to $1,000,000, which is over and above the $1,000,000 for medical-rehabilitation benefits.
Spinal Cord Injuries (Quadriplegia & Paraplegia)
The spinal cord is extremely fragile, and damage to it as the result of a motor vehicle accident can result in paralysis, either paraplegia or quadriplegia. Paraplegia involves the lower portion of the body and the legs, and quadriplegia involves both arms and legs and usually the body. The degree of paralysis is dependent upon the area of the damage to the spine; the higher the injury means the greater the paralysis.
Becoming paralyzed as a result of a motor vehicle accident is life altering for the victim and the family. Feifel Gualazzi has extensive experience with spinal cord injury victims. The road to recovery is a long and complicated one that will require many health care and medical specialists along the way.
Amputations
To lose a limb as a result of an accident has extensive lifestyle ramifications. We have experience dealing with the insurance companies in respect of the modifications which will undoubtedly need to be made to a vehicle, home, workplace, etc. We work to ensure all are done in a timely manner so that you may return to your home and to the most normal life possible.

FINANCIAL SUPPORT FOR YOUR GRIEF
In your time of loss, you deserve to be cared for. In Ontario, your insurance company will cover some costs to help surviving family members pay for expenses like funeral costs and grief counselling.
WRONGFUL DEATH COMPENSATION
The negligence of another person may have caused the fatal accident. In such cases, surviving family members are entitled to compensation from the at-fault driver’s insurance company. An experienced wrongful death lawyer can do that work for you.
Damage recovery for wrongful death will cover direct costs associated with the loss. It also addresses intangible harm to the survivors resulting from the death of their loved one. Potential damages may include:
WRONGFUL DEATH CLAIMS IN ONTARIO
Many families encounter conflicting feelings about deciding to seek compensation for wrongful death. Of course, no amount of money can ever replace your loved one. You may feel you aren’t entitled to seek financial remuneration, but under Ontario law, you can pursue a wrongful death claim if:
WHAT YOU NEED TO KNOW
While it can be challenging to take that first step, a prompt call to a wrongful death lawyer can ensure you meet the necessary deadlines. Ontario law sets time limits within which you might file a wrongful death lawsuit. In general, that limit is two years. If you intend to sue a municipality in Ontario, the time limit is significantly shorter.
To ensure your case can proceed effectively, here are some steps you can take to sufficiently equip your lawyer with the necessary evidence:

LEGAL ASSISTANCE FOR WHIPLASH INJURY CLAIMS
The term whiplash, also known as whiplash associated disorders (WAD), refers to any damage to the muscles, ligaments or tendons in the neck caused by a sudden jerking movement. If the head is rapidly forced in one direction and then another, the soft tissues in the neck and upper back can stretch and tear. This can lead to a variety of symptoms, including:
Although many of these symptoms are similar to those of neck strain, whiplash is a more severe injury that shouldn’t be taken lightly. Since this soft tissue injury generally doesn’t show up on medical imaging or X-rays, doctors must rely on an account of the person’s symptoms to make a diagnosis.
Unfortunately, the lack of a definitive diagnosis — combined with instances of claimants fabricating or exaggerating symptoms — can prompt insurance companies to dispute the validity of a whiplash injury claim. As a result, you need plenty of evidence and the right legal expertise to successfully prove this type of claim and receive compensation.
When you reach out to the team at Feifel Gualazzi, one of our personal injury lawyers will carefully review your case and provide expert advice for how to move forward. We also recommend that you thoroughly document your symptoms, medical appointments and treatments to support your case.
RECEIVE COMPENSATION FOR ASSOCIATED INJURIES
As the term “whiplash associated disorders” suggests, there are numerous symptoms associated with this soft tissue neck injury. In addition to concurrent injuries such as a concussion or pinched nerve, someone who suffers a whiplash-type injury might also experience:
Since many symptoms associated with soft tissue injuries like whiplash can take a while to appear, insurance companies often don’t provide sufficient compensation following an accident. At Feifel Gualazzi, our lawyers have extensive experience representing victims of chronic pain, fibromyalgia and other whiplash-related injuries. We understand how devastating these conditions can be and are available to help you get the compensation that’s rightfully yours.
If you need help proving an accident claim for whiplash and any associated injuries, turn to the dedicated team at Feifel Gualazzi. As one of the largest personal injury law firms in Northern Ontario, we provide excellent service and work tirelessly to get our clients the compensation they deserve.

BRAIN INJURY LAWYERS IN SAULT STE. MARIE
When it comes to severe accidents and brain injuries, the spectrum of impairment and brain damage can range from mild to severe. The consequences can range from a minor headache to cognitive impairment or even death. Brain injuries can influence someone’s personality, even if the effects don’t show up right away.
Brain injuries can have life-altering impacts on the victim as well as their family members and friends. A person who is generally happy and productive may become irritated, tired, and depressed. It can become impossible to maintain employment or relationships and require around-the-clock care and support.
Our team has represented numerous brain-injured individuals which include both adults and children. Depending on the degree of the injury, numerous healthcare professionals located both within the District of Algoma and outside of the District of Algoma come together to truly bring a team approach with the law firm being but one part of a much larger team to assist in the recovery of the victim and to integrate that individual to the greatest extent possible into society. One of our goals is to provide a lifetime of financial security in order for the survivor to have lifelong support with all possible resources that may be available.
We at Feifel Gualazzi recognize that our paramount consideration and goal is to assist in formulating a team of specialists from a wide spectrum of disciplines and professions so that the maximum recovery and quality of life can be achieved for our client and their family.
BRAIN INJURIES & HEAD INJURIES
Visible injuries are easy for others to notice; however, in the case of a brain injury, this is not always the case. The “invisible” injury can be the most devastating injury for the victim and the family.
Brain injuries, sometimes referred to as the “invisible injury,” are often characterized as mild, moderate or severe. They are perhaps the most misunderstood and misdiagnosed injuries but often have a devastating impact on not only the survivor but the survivor’s family and friends, as well.
Even a so-called “mild” brain injury, which is a misnomer, is a totally inadequate description of an injury that can prove to be life-altering for the injured person.
CHILDHOOD BRAIN INJURIES
Children who have sustained an acquired brain injury could be attended by pediatric neurologist, pediatric psychiatrist, assessment by a neuropsychologist with expertise in dealing with infants & children, life skills assistance, assistive equipment for learning along with occupational therapy, development of an individual education program (IEP), the assistance of an educational assistant, vocational assistance, cognitive aids and financial planner to provide money management.
The resolution of a claim involving an individual who has an acquired brain injury, and especially when dealing with children, is an extremely lengthy process. Our team strongly believes that a claim should never be resolved until our client has made the best possible recovery. When dealing with children, very often significant changes occur when the child enters the teenage years and becomes a young adult, which can result at that time in a severe change in personality, anger and other issues as a result of the brain injury.
PROFESSIONAL SUPPORT
Numerous professionals, depending on the unique situation of each case, will be considered which would include catastrophic case management, individual rehabilitation plans, transferable skills analysis, job coach with vocational evaluations and labour market surveys, future care costs analysis, exercise program, anger management, independent living assessments, speech-language pathologist, speech therapist, full-time tutor & assistance at both the elementary & high school level, attendant care, parenting courses, assessments with an audiologist, sleep clinic assessments, assistive devices & home modifications for possibly a new home, recreational therapy, assistance of a personal support worker & rehabilitation support worker and counselling with a social worker or psychologist with expertise in acquired brain injuries.
WHAT TO EXPECT
It may be many years before a claim involving an individual who has sustained an acquired brain injury is resolved and indeed there may be situations where it is in the best interest of the survivor not to resolve the claim at all. Our goal is that once maximum recovery has been achieved through the assistance of the numerous healthcare professionals and other team members involved in the rehabilitation and integration of the injured person into society, final assessments will be obtained such as a future care cost and reports from an accountant/actuary and economist in order to properly quantify the injured person’s needs for the rest of his or her lifetime.
At that time, most often a structured settlement is obtained, which will provide an annuity for the lifetime of the injured person by paying monthly tax-free monies to the injured person or their representative to cover that individual’s potential losses for loss of income, pain and suffering, attendant care, ongoing treatments and medications, counselling, case management, and all other expenses that may occur during the lifetime of the injured person. With children or with an individual who is under a disability, there may be involvement by the office of the children’s lawyer through the public guardian/trustee. Court approval must be obtained to make sure that the settlement and resolution of the claim is truly in the best interest of the injured child or person under disability.

ONTARIO CYCLISTS: KNOW YOUR RIGHTS
Did you know that Ontario cyclists have the same rights as drivers? Consequently, if you’ve been injured in a cycling accident involving a motor vehicle, regardless of whether you’re at fault, you’re entitled to claim accident benefits.
In fact, cyclists are given significant legal protection as they’re among the most vulnerable road users. When determining fault, the Highway Traffic Act (HTA) applies and sets out a reverse onus. This means the motorist is presumed to be at fault for the crash with a cyclist unless proven otherwise.
HOW TO CLAIM COMPENSATION
If you have car insurance, you can claim accident benefits through your insurer. If you don’t own a vehicle or have car insurance, you can file a claim through the insurance policy of the owner of the motor vehicle involved in the crash.
Additionally, if you’re involved in a hit-and-run accident with a vehicle, you can make a claim to the Motor Vehicle Accident Claims Fund. Speak with us today to learn more about how we can help navigate accident benefits claims and make sure you get the compensation that you deserve.

WHAT TO DO IF SOMEONE HAS BEEN HIT BY A CAR
Whether you are the pedestrian who has been struck, the driver of the vehicle or a bystander, these first steps are essential.
In Ontario, car owners are required to have insurance that includes coverage for injuries caused to others in an accident, including pedestrians. Additionally, pedestrians who have car insurance may be covered for injuries sustained in a pedestrian accident, depending on the terms of their policy.

In Ontario, it doesn’t matter who’s at fault; people injured in a motor vehicle accident have the legal right to compensation from their insurance providers. Ontario’s Highway Traffic Act imposes a reverse onus on drivers involved in pedestrian accidents to prove they didn’t act negligently. A driver is presumed guilty until proven otherwise.
COMMON INJURIES SUSTAINED IN CAR ACCIDENTS INVOLVING PEDESTRIANS

WHAT IS A HIT & RUN ACCIDENT?
A hit & run accident is the criminal act of striking a pedestrian, motorist, cyclist, other vehicle or structure and then fleeing the scene of the crime without stopping or providing your contact information.
In Ontario, two laws address hit & run collisions: the Criminal Code’s “fail to stop” law (and the Ontario Highway Traffic Act’s “fail to remain” law. Both laws carry criminal charges for those who commit hit & run accidents.
COMPENSATION FOR VICTIMS OF HIT & RUN ACCIDENTS
Navigating the aftermath of a hit & run accident can be a scary and incredibly daunting experience. The physical and emotional toll can leave you feeling overwhelmed and unsure of where to turn for support. However, if you find yourself in the unfortunate situation of being the victim of a hit-and-run and can’t identify the responsible driver, it’s important to know that you still have options for seeking compensation and damages.
Scenario 1: Driver’s Identity is Unknown
If you suffered injuries in a hit-and-run accident and can’t identify the driver, you’re still entitled to claim statutory accident benefits through your Ontario auto insurance plan from your damages. These benefits typically include compensation for medical expenses, rehabilitation costs, lost wages and more. You can still access these vital benefits to aid in your recovery and ease the financial burden that may have resulted from the accident.
In addition to claiming accident benefits, you have the right to sue your own Insurance company pursuant to the unidentified provisions of your auto policy (Family Endorsement – OPCF 44) as if your Insurance Company insured the unidentified at fault driver for pain and suffering, loss of income; housekeeping/home maintenance and Future Care Costs. In essence your Insurance company will assign two claim’s examiners—one to handle your entitlement to immediate no-fault accident benefits for medical re-habilitation, income replacement benefits and possible attendant care with a 2nd claim’s examiner to handle your claim (as set out above) for future losses such as pain and suffering, future loss of income, housekeeping and Future Care Costs.
Scenario 2: Driver’s Identity is Known
If you can successfully identify the driver who caused the collision, you may be able to obtain further compensation through their Ontario auto insurance plan, such as pain and suffering and loss of enjoyment of life. Even if the other driver doesn’t have insurance, you may be eligible to make a claim to the Motor Vehicle Accident Claims Fund (MVACF) for your injuries.
WHAT TO DO AFTER GETTING INTO A HIT & RUN ACCIDENT
If you’re injured in a hit and run accident and the other driver fled the scene, you must act quickly by taking the following steps:
Finally, it’s important to seek legal advice as soon as possible. A personal injury lawyer can help you understand your rights and weigh your legal options.
